Will wind farms result in caveats on host landholder or neighbour property titles?

A caveat on a property title serves as a legal notice to potential buyers that a portion of the land may be subject to an option or wind farm lease agreement.

For host landholders, the right to register a caveat is included in the contract. However, a caveat can only be registered if there is a formal agreement between the landholder and the developer that meets specific legal requirements. If a caveat is in place, WestWind works closely with host landholders to ensure it does not prevent them from entering into other agreements related to their land, as long as WestWind’s interests are protected.

Importantly, caveats do not apply to neighbouring properties. They are only relevant to landholders who have signed agreements to host infrastructure on their property with the wind farm.
